These Terms of Service ("Terms") govern your use of the HuaHeal website and our patient navigator and medical chaperone services. By engaging our services, you agree to these Terms. Please read them carefully.
1. Service Description
HuaHeal is a patient navigator service, NOT a licensed medical provider. We do not employ doctors, nurses, or any licensed healthcare professionals. Our role is strictly limited to:
- Providing information about medical treatment options available in China.
- Arranging hospital appointments and accompanying you as a bilingual chaperone.
- Facilitating communication between you and your treating physicians.
- Coordinating logistics including hotel bookings and travel recommendations.
- Translating medical records and preparing insurance claim documentation.
All medical decisions — including diagnosis, treatment selection, and surgical procedures — are made solely by you in consultation with the licensed physicians at the hospital you choose. We do not influence, direct, or assume responsibility for medical outcomes.
2. Fees & Payment
- Service fees: Our chaperone service fees are as published on our website (Silver $349/day, Gold $599/day, Platinum $899/day USD). These fees cover our navigation and coordination services only.
- Medical costs are separate: Hospital fees, medication, lab tests, imaging, and all other medical expenses are paid directly by you to the hospital. We never collect or mediate these payments. We provide estimated cost ranges for reference only; actual costs depend on your treatment plan as determined by the treating physician.
- Payment terms: Service fees are due upon booking confirmation, unless otherwise agreed in writing. We accept payment via bank transfer, WeChat Pay, Alipay, or other methods agreed upon during consultation.
- No hidden fees: We charge a flat, transparent fee. We do not take commissions or kickbacks from any hospital, clinic, or medical supplier.
3. Cancellation & Refund Policy
- Before arrival: You may cancel anytime before your scheduled arrival in China. Full refund of our service fee, minus a $50 USD consultation processing charge. No questions asked.
- After arrival: Refunds for cancellations made after you have arrived in China are handled on a case-by-case basis, prorated against services already rendered.
- Hospital fees: Cancellation of hospital appointments and associated medical fee refunds are governed by each hospital's individual policy. We will assist you in the refund process, but hospital policies are outside our control.
- Refund method: Refunds are processed via the original payment method within 14 business days.
4. User Responsibilities
To ensure a safe and effective experience, you are responsible for:
- Accurate information: Providing truthful and complete medical history to your treating physicians. Withholding information may seriously compromise your care.
- Travel documentation: Obtaining the appropriate visa or travel authorization for China. We provide guidance but are not a visa service.
- Medical insurance: Maintaining your own travel and medical insurance. HuaHeal does not provide insurance coverage. We strongly recommend comprehensive travel insurance that covers medical treatment abroad.
- Medical decisions: Making informed decisions about your care after consulting directly with licensed physicians. We encourage you to seek a second opinion before undergoing any major procedure.
- Legal compliance: Complying with all applicable laws in China and your home country.
5. Service Limitations
- No guarantee of outcomes: We connect you with reputable hospitals and qualified surgeons, but we cannot and do not guarantee any specific medical result, recovery timeline, or treatment outcome.
- Hospital availability: Appointment schedules, surgeon availability, and hospital admission are subject to each hospital's operational constraints. We use best efforts to secure timely appointments but cannot override hospital scheduling policies.
- Force majeure: We are not liable for service disruptions caused by events beyond our reasonable control, including but not limited to natural disasters, pandemics, government travel restrictions, or civil unrest.
6. Intellectual Property
All content on the HuaHeal website — including text, graphics, logos, pricing information, and design elements — is our intellectual property. You may not reproduce, distribute, or use our content for commercial purposes without written permission.
7. Limitation of Liability
To the maximum extent permitted by applicable law:
- HuaHeal's total liability for any claim arising from our services is limited to the total service fees you have paid to us.
- We are not liable for any indirect, consequential, or incidental damages, including but not limited to medical complications, travel disruptions, or emotional distress.
- HuaHeal is not liable for the acts or omissions of any hospital, physician, clinic, hotel, airline, or other third-party service provider.
8. Governing Law & Dispute Resolution
These Terms are governed by the laws of the People's Republic of China. Any dispute arising from these Terms or our services shall first be resolved through good-faith negotiation. If negotiation fails, disputes shall be submitted to the competent court in Beijing, China.
9. Changes to Terms
We may update these Terms from time to time. Material changes will be communicated via a notice on our website. Continued use of our services after such notice constitutes acceptance of the updated Terms.
